One thing I have seen the Devs she away from answering is what is going to happen when people transfer and their destination server has someone with the same name, or legacy name, or guild name.

The answer is obvious, you're going to have to change it.

Being forced to switch servers just to make the game playable, than forced to change your name because evidently someone else has more of a right to it than you do.

Maybe there is another way but they are being silent on this topic and to me that doesn't sound good.

I'm so hipster that my names are far too underground and avant-garde for the usual MMO peasantry and inferior minds in general.

Thus I shall not suffer from this.

They were on the server first with the name. Yes they have more of a right to that name than you do. Get over it.

whoa..big news here...how bout reading one of the other 17 threads about this...it happens in all games when there are transfers..nothing new,so stop trying to start something

They are not "hiding" from anything. All of this has been addressed, numerous times, on this very site. Try reading the Dev tracker from time to time, and you might avoid spreading misinformation.

Actually. They haven't shied away from answering it, because it was answered in the Character Transfer, Server Population and You update.

And probably multiple times since then.

Specifically look at this:

For those who have unlocked Legacy abilities, your Legacy will be transferred to your new server and your unlocks will be available there too. If you have already unlocked your Legacy on your destination server, the higher level Legacy will take precedence. For guild members and masters, you will not be able to transfer your guild as a whole to your new server; instead you will need to reform it. If you have a guild bank, it will be re-granted to your new guild on your destination server by Customer Service. This is not an automatic process and you will have to contact Customer Service directly. If your transferred character’s name conflicts with an existing name on a destination server, you will be asked to rename your character. In the case of Legacy names, unless you have unlocked your Legacy on your destination server, you will need to rename your Legacy upon transfer (although you may pick the same Legacy name as on your origin server, if available).

Dude Just put Some ¨ and ç and č and ^ and ř and maybe ´ over you leter in you name. :P This way you gone keep you name . Anyway what is better be along on a dead server or change your name and do some OPS and HM and PVP whit other player? I chose change my name and transfer.

It's no secret. There are plenty of threads and posts complaining about it already.
Looking for a good woman. Able to clean, cook, sew, catch bait, and clean fish. Must have boat and motor.

As it's been mentioned, the issue regarding duplicate names on destination servers was addressed in our blog, both in regards to character names and legacy names:
