I feel that the people that are not granted the 5 days early access of playing time as stated for the additional $5 fee are entitled to a $5 refund. It was a very deceptive advertisement.

up to 5 days is what it said. you pay for even 1 extra day as that's still within the 5 days before launch.
I find your lack of faith disturbing

You should understand the wording a little better. "Up to 5 days early" means at MOST 5 days. They did not promise at least 5 days, there's a huge difference here. As for the 5 dollars, that's a fee for pre-ordering. A placeholder until you pay the full cost of the game on the day it's released.

Ponyswag - Rage Juggernaut [Prophecy of the Five]
Millionz - Pyrotech Powertech [The Fatman]

It says preordering can get you [I]up to[I] 5 days early access. Technically, they only need to give you one day fro it to be early access at all.
Thats not really deceptive, just correctly worded.

The original post said "5 days" not "up to 5 days"

They changed it recently.

Wrong on two counts:

1) the ad. didn't promise five days
2) no one paid extra for it, the 'pre-order' fee is taken off the price of the game, thus EGA isn't charged for

The 5 dollars wasn't for early access. It was a down payment for pre-ordering the game. It's the same as if you went to Best Buy or Gamestop to pre-order.
