So how it is fair?

All I want is equal treatment.

Because it is an unknown whether I will or not. I simply cannot tell you something I do not know. Maybe I could *shrug*? Does that make you happy? How about if I tell you I rarely even bother looking at what drops? Does that make you feel better? I doubt it since you require a set-in-stone stance from everyone.

I will ALWAYS roll need to gear up my companion. Since there is nothing restricting you from doing that while rolling it's "working as intended" as some would say at this point in time.

No...

I don't really care about loot all that much; I'll leave it to the people who care to bring up whatever loot rules they want to run with (that's what the dev suggested, after all)

I agree with the OP, you should only need on companion gear if no other player in the group can use the item.

Every time myself or one of my guild mates are in a group and someone ninjas for their companion, we kick them and add them to our ignore lists. We then share the ninjas name with other guilds that we associate with and they all add the person to their ignore aswell.

Sure enough, we seem to get a lot fewer of those players anymore.

That's because, unless stated otherwise, the gear is available to everyone, which is how it should be. Whether companions should be considered or not considered when rolling on loot is a matter of opinion, which should be beyond the scope of any roll system.

Edit: And yeah, it shouldnt be glossed over, the game saddles you with 5 gear dependent companions.

Well, you might as well say "no that's a bigger upgrade for me, you should pass for me" ... because that's the root of what you're arguing there.

It's an upgrade for both people. Maybe it's a bigger upgrade for one than the other, but that doesn't mean that you should expect people to defer to you.
