Not getting rating is not a penalty. Losing needs to leave you with less rating that you entered the game with. Have you ever played a competitive game before omg. If losses don't lower your rating as much as wins increase it (on average), ratings will inflate as the season progresses. Such a system would heavily incentivize grinding games all season long, rather than maintaining a solid W/L ratio.

If there is no way to lose rating the top players will be people who have the most time to play and are average as opposed to actually the best. And the really good players with tons of time will have ratings in the 6 or 7k range lol.

And what's wrong with that? Especially compared to the current system that just rewards getting lucky in your first ten matches and/or playing over powered classes?

If you lose someone else gains and you are now behind that person. That's a penalty.

So basically, someone could get top 96, then throw all their games so that they keep their competition down, since they won't lose rating for throwing. Right?

No. Well, maybe if they have just a ridiculously substantial lead and even then they run the risk that they would feed their competition enough wins to knock themselves out of the running. Not to mention the fact they might get flagged as a griefer, get suspended, and possibly have their rating reset altogether.

I don't think it's any use trying to reason with these guys. They just want games played to matter more than win rate because they have too much free time and too little skill.

Your suggestion also kills altoholics like myself because you would have to play so many games on any given character to compete with other players' ratings. I would never have been able to get 6 rancors in S1 if this system was in place (and they still gave tier 1 rewards to the top 5%).
