NOT in the context of what you are demanding/insisting however.

But hey, don't take my word for it... consult your attorney and seek his/her legal opinion (in the context of your demand).

I'm too lazy to read the whole thread, so here is my response to the OP.

I would agree with you if it weren't for the fact that anyone can buy a 'digital deluxe edition' upgrade. The items contained within were supposed to be exclusive and they are not anymore. Because of this I would like to purchase an upgrade that would allow me access to the CE store.

My only resentment about CE owners is they won't freaking shut up a bout being CE owners.

I have played games with CEs for over 20 years and none of them have had their communities going on about the CE for so long after launch like it has here.

The CE exclusive store sucks, any moron that bought the CE strictly for its digital content is a moron

To be blunt, the OP is missing the point of why some people (including myself) ***** about CE owners and their attitudes. They routinely act as if because they were able to spend a certain amount on the CE version, they are somehow more entitled than the rest of the community. This is what bother 90% of the people who post about CE owners and what they post around here. Everything from their spoiled, entitled arguments to the smug signatures they wear to distinguish themselves as "different" than the normal players.

Just because you bought a different version of the game doesn't rate you any higher on a customer list or player base than someone who bought the digital deluxe or standard editions. Get over it.

That might be because Bioware actually told those who bought the CE that they were entitled to something extra. Something extra with regular exclusive updates, to be precise.

Ok? What's your point? Don't like it? Unsub and ship the contents of the CE and demand a refund. They did it for GW2. I guess Arenanet does a better job of handling spoiled players: They get rid of them.

You are mixing what they actually said AND confusing real extras with virtual extras. Everything physical and real in the CE box remains yours, even if you leave the game.

As for the non-real, virtual content (which by the way is gone if you quit playing or when the day comes they shut down the game):

1) They said CE owners would have exclusive access the CE merchant, always and forever. YOU DO.

2) They said they would update the merchant regularly with new content. Depends totally on what is meant by regular. I would argue it's not very regular, but there have been updates on the merchant and I have made use of said updates when they went live. And it is exclusive content that only I as a CE owner can gain access to.

1 & 2 are separate and distinct and cannot be carelessly combined as so many CE owners want and try to do. You discredit every CE owner by doing this sort of thing and it's no wonder people take shots at CE owners for being <insert your favorite label here>.

Agreed. It started with CE owners making sure it was noted in their sigs. Not all CE owners are that way, in fact I think most aren't, but those few certainly give the rest of us a bad name. I'm a CE owner, and though I hardly play the game anymore (mostly to help my wife who still thinks it's the greatest game ever), I still have the cool statue of Malgus on my computer desk as well as the other goodies that came with it. Though the game, for the most part, has been a disappointment for me, I still don't feel ripped off (at least if I ever do, it's not for the CE but the game itself).

Right, because watching game chat and forums is a completely representative and scientific way of judging the opinions of CE customers? It isn't like people who are unhappy are more motivated to post then people who are happy, even assuming you don't simply suffer from confirmation bias and screen out anyone who disagrees as being a minority you can ignore.

I bought the Collectors Edition for the following reasons in order of importance:
Journal of Gnost Dural. I'm a sucker for physical things like this written like the are in-universe.
The statue
Music CD
In-game items
Regular updates

I'm not arrogant or stupid enough to think that everyone bought it for precisely the same reasons as I, however logically I think someone claiming a majority bought a package of various items including two largish physical items solely for one digital item needs to provide some significant evidence for such a claim.
