No clarification is needed. The first character with the name on the server gets to keep it. PERIOD. All other variables that you wish to throw in do not matter. You don't have to like it, but that is how it is and it is not going to change.

i've been playing since EARLY beta, if i lose my character's names, i will quit, and there is nothing they can dangle in front of me to get me to return.

people seem to give game developers a free pass...an undeserved one. they get paid to do a job, just like most people that play...

what happens when you miss deadlines, underachieve, lose 400k clients?? well, i'd assume you'd get fired...

and i doubt anyone would be running to your defense.
What part of the EULA says that you are paying for your name and it will never be changed? Frankly the game community is better off without spoiled brats with an entitlement complex.

Age of Conan did this to me, my Ranger/Hunter - with a name I have used for my Ranger/Hunters for nearly a decade - merged servers & I lost the name.

There is nothing they could ever offer me that would bring me back now. I also lost the name of my assassin/rogue ... although I was not so attached to that name I still lost a name of a character whom I identified with that character ...

When I logged in & discovered these name losses I immediately unsubbed & have never returned ... even the new 'Free-to-Play' would not bring me back. They permanently lost me as a paying customer due to their blasé decision to change my character's name.

So many people blast World of Warcraft, yet they made a promise to never close/merge servers & we, as paying customers, would never lose our character names ... a promise they have managed to keep when all the other (failed) mmo's could not.

If you make a decision to Transfer, you make a choice. It is clearly stated that if the name you have is already taken you will have to change your name. If you do not wish to change your name, don't Transfer. That is the ONLY 'Fair' way.

all the snarky comments when somebody complains bout not being able to use a name.

you get attached to its, its why you signed up on day 1 so you can reserve your name. I've had the same handle across multiple MMOs.

What about when they close your origin server, merge you into the other server, your still going to have to change your name.

You are wrong there. Even WoW is plagued with dead servers. Many players opt to transfer out, albeit for a fee, and the same rules apply if your character name is taken on your chosen destination server. In fact, WoW is the only MMO where I lost my character name due to a transfer.

World of Warcraft stated they will never merge or close a server. ANY mmo that sets itself up in direct competition must also be able to make & keep to that same statement.
If BioWare close/merge servers they are stating that they have FAILED in their bit to compete & it is a sign that Free-to-Play is just around the corner.
Thus, if they Close/Merge my server & I lose my name my sister & I leave. We both bought & paid for our pre order as soon as they were available - one of the selling points was the ability to 'Reserve' a name. If they merge/close my server & I am 'forced' to change my name then that means it was simply a means to get my money in some greedy money making scheme.
Thus I will leave, as will my sister & all the other people who feel betrayed by BioWare.
Up until now I have been a paying subcriber since launch & had planned on staying for years ... but with all this talk of BioWare's SWTOR dying as every other mmo has that tried to compete with WoW has, I am not so certain I want to stay with a sinking ship.
Server merging/closing today - Free-to-Play tomorrow.

So, no, I would not be forced to change my name ... as I would simply leave & never return

People saying WoW will never close or merge a server like it's a good thing? It's garbage. There are quite a lot of ghost towns in WoW that are essentially cash traps for new players who wind up forced to paid transfer or abandon characters. It's one of the worst things about the infrastructure of WoW currently.
