Hero Engine: why?

That engine is probably (most definitively) not for sale, and besides, it has it's own limitations.

This is just not true.

Look, you may hate WoW for many, many reasons, but the game engine is what has allowed it to dominate this space. It is extremely difficult to go from something so responsive to something that feels clunky and unnatural. Rift, War, Aion, all had promise, but in the end, the lack of fluidity and control over your toon doomed those games.

DAOC was graphically horrible, but the control was there so people loved it.

Ignoring the only thing that really matters in an MMO has doomed so many MMOs to utter failure. Maybe GW2 will get it right.

One problem I see with the engine is that it looks like even from the demos of Heroengine itself that space combat can only be done on rails.

If SWTOR has no free flight space combat ala Halo Reach then the game is virtually not worth it. So far all the space missions I have done are mostly the same in the sense that enemies always come from your right or left and warn you by making sounds.

I for one would want to ambush people behind an asteroid and chase them in space and do real space combat. This is what I wanted to play in space with swtor and it fear it will never happen.

Most Star Wars fans want a modern version of Tie Fighter vs Xwing

Seriously. Blizzard built an engine to fit their game, they're billions (trillions yet?) richer. You didn't, and you're missing out on Billions in part due to this decision.
Why?
Hero Engine was originally made for a MMO called Hero's Journey that was supposed to release in 2004-2005...however the development company ran out of cash and decided to start selling the engine instead.

Thats why the engine feels so outdated.

Then Blizzard is missing an incredible business opportunity. What better way to protect yourself from obsolescence than becoming part of that which replaces you?

The hero engine is bad. Champions has the same ability lag this game suffers from.
Warhammer has incredibly smooth gameplay compared to swtor from my experience (last played early december 2011, prior to swtor launch).

I assume it was a funding thing, so maybe they couldn't afford to build they're own engine from scratch. Or perhaps they simply didn't have a development team capable of doing it, and they didn't want to bring in new people.

I just wish they had picked a better engine. There were alternatives available.

Either way it's a real shame, and the game has suffered for it. The ability lag and the performance problems alone are a nightmare.

At least they can be fixed.

Only reason I'd be upset is if they'd used an engine they couldn't modify.
