lol, I tanked HM FE for my first hard mode flashpoint wearing moddable gear containing items from the daily group quests. Guess what, it was all tank gear, I had no survival issues, and we cleared it with hardly any problems even though we were all noobs, this was pre nerf by the way. If you havent picked up the recruit gear from the pvp vendor I suggest you do, its probably better than what you have right now. If you use dps gear you might hold threat a little more but your ability to survive boss encounters will plummet due to your lack of defense, shield rating, and absorption. PS That was with a juggernaut in full immortal spec.

Also, in my experience Marauders really are idiots a startling proportion of the time. Sorry to the good ones (I know you're out there) but omg that class attracts morons. This... I feel the same way, in the past 3 weeks Ive only grouped with one mara who didnt try to tank/ run ahead of me. When I heal I let them die every single time.

My main is a tank, I dont have problems being rooted, flung around, etc its part of the game and I have learned to deal with it/ work around it. Yes DPS needs to play with more intelligence, but they are DPS, facerolling through content is their mantra. Healers need to pay attention and cleanse/shield instead they are trying to DPS... In my opinion bad players are the problem, not mechanics.

No, you wont automatically receive one at legacy 10, they must be purchased. If I remember correctly you get a legacy kit after each chapter of your story line. That piece cannot be upgraded though. The kits drop off of random npcs in flashpoints and on planets. Another way to get orange pieces is through pvp, go take a look at the low level pvp vendor and see what you like then grind out points to purchase them.
